Terms & Conditions
By creating an account and or placing an order with us you agree to all of the following terms and conditions;
• With all product and services, prices are subject to change at any time without prior notification.
• A product or service "List Price" indicates the price that we may decide to charge for the product or service at any given time based upon our current supply and input costs, the list price is not intended to indicate a previous price that has been charged for the product it is merely an indication of what we feel would be the upper limit of what we may list the item at under prevailing market conditions, in most circumstances we attempt to make products available below our "list price" to provide our customers the best prices that we can afford.
• All sales are final no refunds will be provided due to changing your mind or for any other reason other than a manufacturing defect that renders the item unrepairable and if we are unable to replace the item, or a valid reason expressly covered by consumer law, see our warranty page for full details (login first). • Please choose your items carefully because in most circumstances exchanges are not possible this is especially the case with machines, procedural items and sterile stock which cannot be exchanged due to health risks.
• Reasonable effort has been taken to describe products accurately but we do not accept liability for minor errors or omissions other than rectifying the description of the item. • We do not warrant that any product is appropriate for your particular needs and in all instances a customer must rely upon their own discretion as to the appropriateness of any particular product for their needs, client base and circumstances. You agree that prior to placing your order you have not relied upon any verbal representations,
external information or any other information about the products other than the information contained in the product listing
on our store.
• All products are stocked at our sole discretion we do not guarantee the future
availability of any product, spare part, consumable or accessory nor do we warrant that any specific
product will be available in any particular quantities, this includes but is not
limited to machine needles and parts. Products may be unavailable for a
variety of reasons therefore no product availability warranties are offered or implied.
• The purchaser warrants that they possess appropriate formal qualifications for the use of any product that they may purchase, additional training by one of our authorised trainers is recommended when purchasing any of our digital cosmetic tattoo equipment (additional costs apply) as your prior training may be inadequate. NB. training offered by training organisations that are not authorised amiea distributors may not be adequate or appropriate for use of advanced amiea equipment. • No liability is accepted for adverse outcomes, incidental or consequential losses as a result of the use of any product other than a valid reason expressly covered by consumer law. In all instances the purchaser must ensure that they are following the manufacturers instructions as well as all applicable acts, regulations and standards as well as reasonable safe use of the products. • Occasionally items may be substituted for the item described in the listing in instances where we have changed suppliers and or the item described in the listing is unavailable and the substituted item is of a similar quality & design or is of negligible difference to the listing description. • Products are shipped subject to confirmation that payment has been received, in the event of a payment rejection or chargeback we shall retain a lien over the products and the customer must either return the full order to us upon our demand and at their expense, or provide us with full payment inclusive of any costs incurred, the choice of resolution is solely at our discretion.
• Orders will be shipped to the shipping address within the customers account profile, it is the customers responsibility to ensure that their account details are up to date and correct within their account profile
by checking before placing each and every order,
the customer agrees that confirmed delivery is deemed to have occurred if
delivery confirmation is provided by AusPost or another shipping service as may
be used from time to time. If a transit insurance option was chosen insurance
cover ceases once delivery has occurred.
• In the event of any delays, service failures or delivery disputes with AusPost
or other shipping service it is the customers responsibility to resolve those
matters direct with the delivery service and to immediately follow any
instructions that we may provide for communication with the delivery service.
Failure to comply with our instructions will void any insurance cover that may
have been selected. It is the customers responsibility to track the progress of
their order and in the event of a missing delivery the customer must notify the
delivery service immediately on the day of delivery failure to do so will
void any insurance option that was chosen by the customer. If a shipping method
is chosen that does not include 'Signature Required' the customer bears full
liability in the event that the parcel is delivered in their absence.
• If the customer opts for a shipping method that includes insurance please
note that if you provide instructions for your delivery to be left unattended,
or have any arrangements for parcels to be diverted to another location or
provided to a third party or delivered without signature required this may void
your insurance cover. Insurance will not cover your parcel for any loss or
damage after it has been delivered.
NB. Changes to customers account profiles (including shipping address) will not be accepted via any other method other than by the customer making the change themselves after logging in to their account management area, please do not email us asking us to change your details for you.
• Customers may only pay for their order via one of the methods offered at checkout. International customers should note that charges may be levied by their bank, our bank, and or intermediary banks for payments made via interbank transfers and in that instance the customer will be liable for any such charges by the financial institutions involved, in the event of a refund on an order the refund shall be limited to the funds that we actually receive less any costs, fees, and charges to transfer the funds back to the customer. We recommend that customers make payment using the credit card option via PayPal or their PayPal account balance.
• With some International orders customers may require import approvals,
licences/registrations and or special clearances for some products in some
countries, in addition there may be local taxes and duties payable this is the
purchasers responsibility. We are unable to assist with and are not responsible
for any customs delays, seizures, taxes and duties, fees or charges once an
order has been shipped. Therefore we recommend that all customers check with
their local customs office and regulatory bodies for any requirements and import
costs prior placing an order. • Customers are not permitted to allow their account to fall into overdue, any account that has payments outstanding for more than 7 days shall be considered overdue and will be subject to interest charges at the rate of 1.5% of the outstanding amount per month or part thereof. Overdue accounts may also be suspended or closed at any time at our sole discretion and without prior notification. Unfortunately our margins are too low to offer payment in arrears or to carry overdue accounts. • The purchaser shall be responsible for all shipping costs inclusive of any shipping costs for warranty and or repairs, it is advisable to ensure that any items returned by you for warranty or repairs are sent via registered mail with insurance to protect you from the cost of loss or damage to your items.
In the event that we agree to the return of any product for any reason the
customer accepts that they are responsible for any return shipping costs. • All customers are expected to abide by a reasonable standard of conduct as defined by us, we have a zero tolerance policy towards certain types of behaviour this includes but is not limited to; abusive or argumentative communications, making false claims, providing false information in account profiles, chargeback's and payment defaults, interference with our normal site operation, plagiarism of our site content or publications, beaches of our copyright or the copyright of our trading partners & suppliers, discrediting our products and services,

All of the supplies and equipment that are offered via this site should be considered solely as cosmetic and not as therapeutic in nature.
• If you purchase partial lots of sterile stock then on some occasions the individual items will not be marked with the expiry date in that instance the maximum expiry date will be 12 months from the date of purchase, if the expiry is less than 12 months after the date of purchase and it is not detailed on the individual item then you will be notified after ordering. Multi use bottles of pigments should not be used beyond 6 months after the date of opening of the bottle or the expiry date whichever date occurs soonest. Sterile stock should not be used beyond its expiry date under any circumstances. • All accounts must be in a single name third party accounts are not permitted, as part of our anti-fraud measures if the account holders name is different to the payment maker/card holder you may be asked to supply proof of identification.
Creation of secondary or multiple accounts by a customer is strictly prohibited and can lead to communication problems, processing errors and
delivery failures caused by incorrect or duplicated account information supplied
by the customer. In the event that any error or delivery failure occurs as a
direct or indirect consequence of a secondary account created by the customer
the customer shall bear full liability for any adverse outcome or event and any
insurance option chosen by the customer for their order shall be null and void, the customer bears the risk of total loss of their purchase
in this circumstance.
• Special requests, non standard ordering and or other circumstances that
involve additional administrative intervention outside of our automated ordering
system may incur a 20% surcharge.
• Competitors who misrepresent themselves by creating fraudulent customer accounts for the purpose of accessing commercially sensitive "customer only information" will be billed for any and all costs associated with blocking their unauthorised access to the store. • We reserve the right to ask for additional information from the customer in instances where account profiles are incomplete or if an account profile appears to be inaccurate or if we have concerns about the customers intended use or our products and services or if we have concerns about the customers identity or if we have concerns that our distribution agreements are being undermined. If the customer refuses our request for additional information or does not completely satisfy our request for information their account and site access may be suspended and or closed permanently at our sole discretion.
• The purchaser agrees that in the event of any dispute or for any other reason the laws of Victoria Australia shall apply and the courts and tribunals of Victoria Australia shall have jurisdiction in any and all circumstances.
• We recommend that customers order all products in full packs as provided by
the manufacturer for the best level of protection during shipping, where the
option of ordering a partial pack is provided due care will be taken by us for
packaging but the customer assumes the risk of damage during transport.
• It is a warranty condition with all our products that the purchaser must only use original parts, accessories and consumables as per the brand of the product purchased from us, for example only original Amiea branded accessories should be used with an Amiea device; use of non Amiea supplies such as non original needle chambers may damage the device and void your warranty.
• In all instances we shall comply with all applicable consumer legislation and regulations, where there is any doubt customers should seek independent advice regarding their rights and discuss with us any concerns that they may have regarding our policies.
• If a customer makes a payment to us via PayPal and in the event that a
refund is requested by the customer for any reason either in part or full and if
at our sole discretion we accept the request and agree to the refund then the
customer agrees to accept the refunded amount less the fees charged by PayPal on
the original transaction, in some circumstances at our sole discretion we may
offer the customer a store credit in lieu of any refund.
• Inclusive within our policies and terms is all of the additional information
provided on our Shipping, Warranty & Returns, Taxation page which is only viewable to account holders once they log in
to their account.
Strict Condition Of Sale On All Products: Any warranty that may be provided
with a product including any manufacturer warranty is 'Non Transferable' this
means that the warranty only applies to the original purchaser, if the original
purchaser sells, loans or transfers ownership to any third party then any
applicable warranty is not transferable and will immediately expire.
• If any provision of these terms & conditions or the application thereof to any person or circumstances is held legally invalid, such invalidity shall not affect other provisions or applications of these terms & conditions which can be given effect without the invalid provision or application, and to this end the provisions of these terms & conditions are severable. In lieu any invalid section of these terms there shall be substituted a provision as determined by us of similar content and intent as may be legal, valid and enforceable.
